Official Rules

NO PURCHASE NECESSARY TO ENTER, PLAY OR WIN. The promotion shall be construed and evaluated according to United States law. Do not participate in the promotion if you are not a legal U.S. resident. Void in Puerto Rico, all other U.S. territories and possessions, and where prohibited.

1. Eligibility: The DailyCandy 100-Day Giveaway Presented by Comcast.net (the "Promotion") is only open to legal residents of the United States who reside in the 50 United States and the District of Columbia who are 18 years of age or older at the time of participation. Potential winners may be required to provide proof of legal U.S. residency (in a form satisfactory to Sponsor) if requested by Sponsor to determine eligibility and as a condition of prize award. Employees, agents, officers and directors of Comcast Interactive Media ("Sponsor"), DailyCandy Inc., RealTime Media, Inc. (collectively, with Sponsor, the "Promotion Entities"), and their respective parents, affiliates, subsidiaries, franchisees, divisions, advertising, promotional, fulfillment and marketing agencies (collectively, "Released Parties"), and their immediate families (parent, child, sibling and spouse and their respective spouses, regardless of where they reside), and persons living in the same households as such individuals (whether related or not) are not eligible to enter or win. By participating, you agree to abide by these Official Rules and to the decisions of the Promotion Entities whose decisions are final and binding in all respects. Void in Puerto Rico, all other U.S. territories and possessions and where prohibited by law, rule or regulation. All applicable federal, state and local laws and regulations apply.

2. How to Participate: The Promotion begins on June 15, 2009 at 12:00 P.M. Eastern Time ("ET") and ends on September 22, 2009 at 11:59 P.M. ET (the "Promotion Period"). The Promotion consists of a sweepstakes ("Sweepstakes") and an instant win game ("Instant Win Game"). Limit one (1) Instant Win game play and one (1) Sweepstakes entry per person and per email address per day.

To enter, visit http://www.comcast.net/sweepstakes/dailycandy (the "Web Site") during the Promotion Period. There, you will be asked to register for the Promotion by entering your true and correct information on the registration form. Registration is free. Submit completed registration form as indicated to receive one (1) entry into the Sweepstakes and play the Instant Win Game. The Instant Win Game is a tic-tac-toe game, where you will be instructed to click on each of the squares in the game play area to reveal the prize images. If three (3) of the exact same images are revealed on any straight horizontal, vertical or diagonal line, you will win the prize shown (subject to verification of eligibility and compliance with the terms of these Official Rules).

Returning Participants: You are only required to complete the online registration form the first time you register for the Promotion. In order to earn an additional Sweepstakes entry and Instant Win game play each day, you may return to the Web Site and follow the links to the Log-in Page. When you log in you will receive one (1) entry into the Sweepstakes and one (1) Instant Win game play for that day.

Additional Entries: Upon completion of the Instant Win Game, you will be provided with a custom URL which you can use to invite others to enter the Promotion. To participate, you will be instructed to copy and paste your custom URL or click on the "Share" button to post the URL to one of the listed websites. You will receive one (1) additional Sweepstakes entry for each eligible and unique person who registers for the Promotion via your custom URL. In the event the same person clicks the URL and registers for the Promotion more than one time, you will only receive a Sweepstakes entry for the first time that person clicks the URL and registers for the Promotion. Limit: Up to Ten (10) additional Sweepstakes entries may be earned from referral registrations per person per day for the entire length of the Promotion.

Game plays or entries received from any person or email address in excess of the stated daily limitation will be void. A day is understood to start at 12:00:00 A.M. ET and end at 11:59:59 P.M. ET the same day, except for the first day, which for the purposes of this Promotion begins at 12:00 P.M. ET. If you receive a winning Instant Win message, you will be directed to follow the directions to complete and submit the online prize redemption form. You will also be sent an email prize confirmation message to the email address provided during registration stating that you may have potentially won the prize indicated in the message and be provided with a link to the prize redemption form. All prize awards are subject to verification of eligibility and compliance with these Official Rules. All prize redemption forms must be completed and returned by September 23, 2009 at 11:59:59 P.M. ET. Failure to timely claim prize will result in prize forfeiture. If you receive a non-winning message on your screen, you are not a winner of an instant win prize. Any attempt to use multiple email accounts or other tactics to register, enter or play more than the stated limits may result in the disqualification by the judges or Sponsor from the Promotion and all associated registrations, entries, game plays and/or prize claims will be void. Entries, game plays and registrations generated by script, macro or other automated means or with the intent to subvert the registration, entry or game play process will be void.

Except as noted in these Official Rules, information collected for this Promotion is used only for the purpose of Promotion administration and winner notification, and will not be re-used, sold or shared in any manner by Promotion Entities or any third parties unless participant has elected to receive additional information and promotional material from the Sponsor or a third party. By participating in the Promotion, participant agrees to all of the terms and conditions of the Comcast.net Privacy Policy, which is available at http://www.comcast.net/privacy. In the event of any discrepancy between the Comcast.net Privacy Policy and these Official Rules, these Official Rules shall control and govern.

Registrations, entries, game plays and/or prize claims will be deemed to be made by the authorized account holder of the email address submitted at time of registration and he/she must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner may be required to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the email address associated with the potentially winning entry or/or game play.

3. Instant Win Game Prizes Available and Odds of Winning: A total of one hundred (100) random, computer-generated winning times, (one (1) prize per day) for each Instant Win Game Prize listed below, will be generated during the Promotion Period. One (1) prize will be selected to be awarded each day. If you are the first to play the game at a randomly determined winning time, as determined and verified by Sponsor, or if no one plays at such time and you are the first to play immediately after such time, as determined and verified by Sponsor, you will receive a winning message. Odds of winning a prize depend on the number of eligible game plays received and the date and time of game play. The quantities, description and Approximate Retail Value ("ARV") of each specific prize to be awarded in the Instant Win Game hereunder are as follows:

Total ARV of all Instant Win Prizes is $37,839. The return of any prize email or prize as undelivered or noncompliance with these Official Rules by any potential winner will result in forfeiture of prize. Unclaimed Instant Win Prizes will not be awarded. Limit: One (1) Instant Win Prize per person and per email address.

4. Sweepstakes Grand Prize, Drawing, And Odds of Winning: The potential Grand Prize Winner will be selected in an electronic randomized drawing from all eligible entries received. Odds of winning depend on the number of eligible entries received. The drawing will be held on or about September 30, 2009.

Grand Prize (1): Winner Takes All! Ultimate Prize Pack. Grand prize consists of one (1) of each the following items:

Total ARV of the Grand Prize is $5,378.90.

The total ARV of all Promotion prizes (Instant Win and Sweepstakes combined) is $43,217.90

5. General Prize Restrictions: In no event will more than the number of prizes stated herein be awarded. If due to seeding, technical, typographical, printing, electronic or other errors, the number of valid prize claims received for any prize exceeds the number of such prize set forth herein, Sponsor reserves the right to conduct a random drawing to award the stated number of prizes for the prize from among all valid and non-suspect prize claims received for such prize. Winners are responsible for all federal, state and local taxes as well as all costs and expenses associated with prize acceptance and use not specified herein as being awarded. No substitution, cash redemption or transfer of any prize (or portion thereof) is permitted, except by the Promotion Entities who reserve the right, in their sole discretion, to substitute a prize (or portion thereof) of comparable or greater value. Prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. Any portion of a prize not accepted by winner will be forfeited. If any winner is at least 18 but still considered a minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. All prize details including the color/pattern of all prizes are at Sponsor’s sole discretion.

6. Prize Awarding: The Promotion Entities will award prizes only upon winner confirmation, verification and final approval. All Instant Win prizes valued below $600.00 will be fulfilled 6 to 8 weeks after the winner has been verified. The potential Sweepstakes winner and Instant Winners of prizes valued at $600.00 or above may be notified by phone or e-mail and will be required to satisfactorily complete an Affidavit of Eligibility, a Liability and Publicity Release, and W9, all of which must be returned to RealTime Media within ten (10) days of date of issuance of winner notification. If a potential winner of a prize valued at $600.00 or above cannot be contacted; is ineligible; fails to return the required documents within the specified time period, if a prize notification is returned undeliverable; or otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and, if a potential Sweepstakes winner, the prize may be awarded to an alternate winner as selected by the Promotion Entities from among all remaining eligible entries received.

7. General: Each winner hereby expressly grants to the Promotion Entities and their respective designees all rights to use and publish his/her name, likeness (photographic or simulated), voice, and city and state of residence for solely advertising, marketing, promotional and publicity purposes in connection with this Promotion ("Advertising"), in any and all media now or hereafter devised, worldwide in perpetuity, without any form of notice or any amount or kind of compensation or permission, except where prohibited by applicable law. All copyright, trademark or other intellectual property rights in such Advertising shall be owned by Sponsor or its licensors and winning participants hereby disclaim and waive any claim of right to such Advertising. Such Advertising shall be solely under control of Sponsor or its licensors, and winning recipients hereby waive any claim of control over the Advertising content as well as any possible claims of misuse of winning recipient’s name, likeness or voice under contract, tort or any other theory of law. Winners also agree that, upon reasonable notice, they will use good faith efforts to be available to travel for the promotional purposes of Sponsor for a period of one (1) year from the end of this Promotion. In the event any winner is required to travel for promotional purposes, Sponsor agrees to pay all costs associated therewith.

This Promotion is conducted in English (which will be given its everyday ordinary meaning), and any and all disputes will be resolved in accordance with the laws of the Commonwealth of Pennsylvania without regard for conflict of laws principles.

8. Conduct By participating in this Promotion, participants agree to be bound by these Official Rules and the decisions of the Promotion Entities, which shall be final, binding and non-appealable in all respects. The Official Rules will be posted on the Web Site throughout the Promotion Period. Failure to comply with these Official Rules may result in disqualification. The Promotion Entities reserve the right at their sole discretion to disqualify any individual found to be tampering with the participation process or the operation of the Promotion or the Web Site; or to be acting in any manner deemed the Promotion Entities to be in violation of the Official Rules; or to be acting in any manner deemed by the Promotion Entities to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person and void all associated entries, game plays and/or prize claims. CAUTION: ANY ATTEMPT BY A USER OR PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitations Of Liability: Released Parties assume no responsibility or liability for (a) lost, late, stolen, undelivered, inaccurate, incomplete, delayed, misdirected, damaged or garbled registrations, entries, game plays, prize redemption forms, prize claims, or emails; (b) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (c) any unauthorized access to, or theft, destruction or alteration of entries or game plays at any point in the operation of this Promotion; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, cable, satellites, servers, computers or providers utilized in any aspect of the operation of the Promotion; (e) inaccessibility or unavailability of the Internet or the Web Site or any combination thereof or for computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing, seeding or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, prize claims, prize redemption forms or game plays, the announcement of the prizes, or in any other Promotion-related materials; or (f) any injury or damage to participants or to any other person's computer which may be related to or resulting from any attempt to participate in the Promotion or download of any materials in the Promotion. If, for any reason, the Promotion (or any part thereof) is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, then the Promotion Entities reserve the right at their sole discretion to cancel, terminate, modify or suspend the Promotion in whole or in part. If terminated, the Promotion Entities may, at their discretion, award the Grand Prize from among all non-suspect, eligible entries received for the Sweepstakes up to time of such action.

10. Releases: All participants, as a condition of participation in this Promotion, agree to release and hold harmless Released Parties from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained, in whole or in part, directly or indirectly, in connection with accessing the Web Site, participation in any aspect of the Promotion, or the receipt, ownership or use of any prize awarded.

11.
